A similar Duke Caboom toy was released along with Toy Story 4 by, despite the efforts of avoiding any comparison in the character, Evel Knievel’s son is suing Disney seeking damages of more than $300,000.
He claims that Disney-owned Pixar fail to seek for proper permission to use his father’s likeness when it was creating the Duke Caboom character .
The federal trademark infringement lawsuit includes false endorsement and unjust enrichment. The 60-year-old said: “Evel Knievel did not thrill millions around the world, break his bones and spill his blood just so Disney could make a bunch of money.”
Disney through its spokesman said that it will defend itself vigorously.
Knievel who was famous for stunts such as a motorbike jump over a row of buses at Wembley Stadium, had on many occasions sustained serious injuries, but later died of lung disease.
